ISL suspends Shayna Jack following positive test

The International Swimming League (ISL) has suspended Shayna Jack, who was selected to compete for the Cali Condors in the inaugural edition of the competition, scheduled to begin in October. A statement from the ISL said that Jack has been suspended following her ‘doping violation’, despite the Australian Sports Anti-Doping Authority (ASADA) clarifying that it has yet to conclude if an anti-doping rule violation (ADRV) has taken place.

As reported yesterday, Jack was provisionally suspended by Swimming Australia on 12 July, after a positive test (adverse analytical finding – AAF) for Lingradol (LGD-4033) on 26 June. In a statement, Jack said she had never heard of the substance, adding that she now knows it can be found in contaminated supplements.

Article 7.9.1 of the World Anti-Doping Code clarifies that ‘A mandatory Provisional Suspension may be eliminated if the athlete demonstrates to the hearing panel that the violation is likely to have involved a Contaminated Product’. Last week, Crystal Palace footballer Mamadou Sakho launched a £13 million lawsuit against WADA, alleging that its unsound Regulations and science were responsible for UEFA implementing an incorrect provisional suspension. As such, if Jack is cleared, she may be entitled to take similar legal action against the ISL for wrongful suspension.
